The GDPR clause

Fulfilling the obligation arising from Art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Regulation on data protection, hereinafter referred to as "GDPR"), we inform you that:

  1. The administrator of your personal data is the Academy of Physical Education in Katowice [ul. Mikołowska 72a, 40 – 065 Katowice] – hereinafter referred to as the "Administrator".
  2. At the Academy of Physical Education in Katowice has been appointed Data Protection Inspector, who can be contacted via e-mail: iod@awf.katowice.pl
  3. The administrator collects and processes your personal data:
    1. in order to conclude and implement the provisions of the concluded contract. The basis for the processing of personal data in this respect is Art. 6 section 1 letter b GDPR;
    2. in order to fulfill the legal obligations incumbent on the Administrator resulting from the provisions of generally applicable law, in particular tax law. The basis for the processing of personal data in this respect is Art. 6 section 1 letter c GDPR in connection with with the relevant provisions of generally applicable law, in particular tax law;
    3. in order to establish, pursue or defend claims that the Administrator may raise or that may be raised against him. The above purpose is a legitimate interest pursued by the Administrator. The basis for the processing of personal data in this respect is Art. 6 section 1 letter f GDPR;
    4. for other purposes, if you give your voluntary written consent. The legal basis for the processing of your personal data in this respect is Art. 6 section 1 letter a GDPR.
  4. Providing your personal data is a condition for concluding a contract. If you do not provide the personal data required by the contract, its conclusion will not be possible. This does not apply to personal data processed on the basis of consent - providing this data is voluntary, and if it is not provided, it will not be used for the purposes indicated in the consent clause.
  5. In connection with the concluded contract, your personal data may be transferred to the competent public administration bodies, banks (only for the purpose of payment of remuneration), law firms, in the event of the need to establish, pursue or defend claims that the Administrator may raise in connection with the concluded contract or which may be raised against him.
  6. Your personal data will be processed for the period necessary to perform, terminate or expire the concluded contract, and then for the period required by law, in particular tax law, or until the claims expire. This does not apply to personal data processed on the basis of consent - in this case, your personal data will be processed until it is withdrawn or until the purpose for which the data was or will be collected becomes obsolete.
  7. The Administrator informs that you have the right to:
    1. request the Administrator to access your personal data;
    2. if the personal data processed by the Administrator is incorrect, you have the right to rectify it, i.e. request that it be changed or supplemented;
    3. if your personal data are not needed by the Administrator for the purposes for which they were collected; when an objection has been filed under the conditions described below; when data should be deleted in order to fulfill an obligation arising from a legal provision, you have the right to request that the Administrator delete this personal data;
    4. if you question the accuracy of your personal data, you may request the restriction of their processing for a period enabling the Administrator to verify the accuracy of this data;
    5. apart from the case indicated in point d), you have the right to limit the processing of personal data if the personal data are processed by the Administrator unlawfully, but you do not want the Administrator to delete them; when your data will not be needed by the Administrator, but may be needed to defend or pursue your claims; or when you object to the processing of data on the terms described below until it is determined whether the legally justified grounds on the part of the Administrator override the grounds for objection;
    6. to request the transfer of your personal data indicated by you.

  1. If your personal data are processed on the basis of your consent (Article 6(1)(a) of the GDPR), you have the right to withdraw it at any time, which, however, does not affect the lawfulness of the processing carried out before the withdrawal of this consent. A declaration of withdrawal of consent can be sent to the Data Protection Inspector (contact details are indicated above).
  2. If, in your opinion, the Administrator has violated the provisions on the protection of personal data, you have the right to lodge a complaint with the competent supervisory authority, i.e. the President of the Personal Data Protection Office.
  3. You have the right to object to the processing of your personal data if the processing of your personal data is based on a legitimate interest (Article 6(1)(f) of the GDPR). In such a situation, the Administrator will no longer be able to process your data, unless it has an important legitimate basis for doing so, overriding your rights and freedoms or a basis for establishing, pursuing or defending its claims. You can submit this objection directly to the Data Protection Inspector (contact details as above).
  4. The data you provide will not be transferred to a country outside the European Economic Area.
  5. The personal data provided by you will not be processed automatically (i.e. without human intervention), in particular they will not be subject to profiling.
